Law n. 675 of 31.12.96: Protection of individuals and organisations with regard to the handling of personal data, published in Italian Official Gazette n. 5 of 8th January 1997 - Ordinary Supplement n. 3.
Art. 13 - Rights of the individual or person concerned:
1. With regard to the use of personal data, the affected individual or company is entitled:
a. to be aware, through free access to the register referred to in article 13, subsection 1, point a), of the use of data which may relate to him;
b. to be informed on the subjects covered by article 7, subsection 4, points a), b) and h); to receive, from the holder of the data or person in charge of their use, without delay:
1. the confirmation of whether or not personal data relating to him exist, even if they have not yet been registered, and communication in intelligible form of the data themselves and their origin, and the logic and aims on which their use is based; unless justified reasons exist, such requests may not be repeated at intervals of less than ninety days;
2. the deletion, conversion into anonymous form or freezing of all data used in breach of the law, including those the conservation of which is not necessary for the purposes for which the data were collected or subsequently used;
3. the updating, correction or, if this is in his interest, the supplementation of the data;
4. The certification that the operations referred to in points 2) and 3) have been reported, also with regard to their contents, to those to whom the data have been communicated or distributed, unless compliance with this condition is impossible or involves a use of resources manifestly disproportionate to the right protected;
d. to oppose the use of the personal data relating to him, in whole or in part, for legitimate reasons, even if such use is relevant to the purpose for which they were collected; to oppose the use of the personal data relating to him, in whole or in part, for the purposes of business information or the dispatch of advertising or mail order sales material, or for the performance of market research or interactive business communications, and to be informed of his entitlement to exercise this right free of charge by the holder of the data, not later than the time when the data are communicated or distributed.
2. For each request made under subsection 1, point c), clause 1), if the existence of relevant personal data is not confirmed, the person or company involved, may be charged a contribution to expenses not exceeding the costs actually incurred, by the procedures and within the limits set by the regulations contained in article 33, subsection 3.
3. The rights as referred to in subsection 1 relating to deceased persons may be exercised by any interested party.
4. When exercising the rights as referred to in subsection 1, the person concerned may act through another person or association authorised in writing.
5. The rules on professional secrecy as applicable to journalists continue to stand, with regard to the source of information only.
